  19. Question: Is a "declared emergency" required for the RACES to be
  20. activated?
  21.  
  22. Answer: "No, that is one of the myths about RACES, and it is NOT
  23. true.

  25. The "declared emergency concept" is a fifty-year old hold-over of
  26. the long-gone idea that the RACES was to be a special service in
  27. which Amateurs would operate in wartime, hence a "declaration" by
  28. the president. One has only to read Section 97 to realize that
  29. was its genesis.
  30.  
  31. Today, the understanding and use of the RACES is quite different.
  32. It is NOT necessary that there be a declaration of an emergency
  33. in order to activate the RACES. It is activated in countless
  34. emergencies without a declaration having proceeded that
  35. activation. All it takes is authorization by the person named in
  36. the RACES plan for that purpose. A simple "can you call in some
  37. of the RACES people" is all it takes.

  39. A declaration, when and if utilized, is to invoke laws such as
  40. those that provide access to state or federal funds. If there is
  41. no need for that declaration, the agency responds anyway, and so
  42. can the RACES. In fact, there are emergency management agencies
  43. that activate their RACES the moment they activate any other
  44. staff personnel; even in a potential emergency, such as a hazmat
  45. spill of unknown materials. Nonetheless, there are still those
  46. who carry this idea firmly entrenched in their minds as the
  47. result of misinformation in various publications, so the
  48. situation warrants review.

  50. From time to time we see this statement: "Once the emergency is
  51. recognized by a state or federal agency it becomes a "declared
  52. emergency". That is false, as it implies that the local
  53. jurisdiction has no control, when in fact it is the local
  54. jurisdiction that may first declare the emergency in order to
  55. gain outside help. Further, the recognition of an emergency is
  56. not in and of itself a declaration. A declaration is a
  57. proclamation for certain legal purposes, not activation of the
  58. RACES. It is important to realize that a declared emergency may
  59. NOT invoke the call-out of a RACES unit any more than a
  60. non-declared emergency. NEED determines call-out, not
  61. "declaration".
